Welcome to QevolveX. These Terms of Service ("Terms") act as a legally binding contract between you (the "Customer" or "User") and Quantum Evolution Technologies ("QevolveX," "we," "us," or "our") governing your access to and use of our Resume AI HR Intelligence Platform and related services.
By registering for an account, accessing, or using our platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our services.
1. Use of Services
1.1 Eligibility & Account Security
Under the Indian Contract Act, 1872, you must be at least 18 years of age and competent to contract to use our services. If you are accepting these Terms on behalf of a company, you represent that you have the authority to bind that organization. You are responsible for maintaining the confidentiality of your account credentials.
1.2 Acceptable Use & Prohibited Content
In compliance with the Information Technology (Intermediary Guidelines) Rules, 2021, you agree not to use the platform to host, display, upload, modify, publish, transmit, store, update, or share any information that:
- Belongs to another person and to which you do not have any right or lawful consent to process.
- Is defamatory, obscene, pornographic, invasive of another's privacy, or otherwise unlawful.
- Infringes any patent, trademark, copyright, or other proprietary rights.
- Contains software viruses, malicious code, or any computer code designed to interrupt, destroy, or limit the functionality of the platform.
- Threatens the unity, integrity, defense, security, or sovereignty of India, or public order.
2. Customer and Candidate Data
2.1 Ownership: You retain all rights, title, and interest in and to the candidate resumes, job descriptions, and user inputs you upload ("Customer Data"). QevolveX claims no ownership over your Customer Data.
2.2 License to Process: By uploading data, you grant QevolveX a worldwide, non-exclusive, royalty-free license to use, host, store, and process this data solely for the purpose of providing the platform services.
2.3 AI Training: QevolveX utilizes third-party Enterprise LLMs with strict Zero Data Retention policies. We expressly guarantee that your Customer Data and Candidate Data are not used to train these foundational AI models.
3. Subscriptions and Payment Terms
3.1 Paddle as Merchant of Record
All billing, payment processing, invoicing, and tax collection (including applicable GST) are handled by our Merchant of Record, Paddle. By subscribing, you agree to Paddle's respective checkout terms and conditions.
3.2 Subscriptions & Refunds
Services are billed on a subscription basis. Payments are non-refundable except where explicitly required by applicable consumer protection laws in India. You may cancel your subscription at any time; your access will remain active until the end of your current billing cycle.
4. Limitation of Liability & Disclaimer
Disclaimer of Warranties
The platform and AI-generated insights are provided "as is" and "as available". QevolveX does not guarantee that the AI evaluations are completely error-free or free from bias. Final hiring decisions rest entirely with you.
To the maximum extent permitted by applicable Indian law, QevolveX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, incurred by you or any third party, arising from your use of the platform.
5. Indemnification
You agree to defend, indemnify, and hold harmless QevolveX, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights (including data privacy rights of job candidates).
6. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts situated in Pune, India.
